- Collecting Your Data
2.1 When you register on our websites, complete our contact form, sign up for educational content e.g. free reports, blueprints, webinars etc. or purchase services from us, we will collect your name and email address or name, email address and physical contact address depending on the nature of the content/purchase. If you register on behalf of your employer or any other party, you warrant that you have the authority to do so.
2.2 All personal data that you provide to us must be true, complete and accurate. You must not register under someone else’s name without due consent.
- Use of your personal data
3.1 Except otherwise expressly indicated, we will use your personal data to provide you with the specific content, products and services you request and furthermore to send you free weekly educational tips, updates on our latest events and special offers from across the business – which you are free to unsubscribe from if wished at any time.
3.1b When you contact us in general, we will simply use your personal data, to deal with any questions or complaints you make.
3.1c The majority of the emails we send will contain an ‘unsubcribe link’ at the bottom. You are free to remove yourself from our mailing list/s at any time simply by clicking on the unsubscribe the link provided. Refusal to do so implies consent to receive further relevant opt-in correspondence from us. Should you click on this link, in the first instance, and encounter any problems whatsoever with unwanted emails henceforth, do contact us by email and we will investigate the matter and if necessary, have you manually removed from the system.
3.1d Please note that due to the number of subscribers on our database, it would be time consuming to manually remove every person who no longer wants to receive email correspondence. It is your responsibility to use the ‘unsubscribe link’ provided.
3.2 You understand and agree that if you participate in any relevant group based training or events, your personal data may be shared with other users of these services. Our group based training and events may involve the exchange of information through social media groups or video link with other users and therefore your name and image will be shared with other users. If you request that we help you to find a contact, we will share your personal details with all or any registered users of our networking or alerts services.
3.3 You also understand and agree that if you attend one of our events, your name and email address will be shared with all other delegates attending the event. You agree only to use another delegate’s contact details for business purposes related to the relevant training or networking.
3.4 You shall treat all personal data and other information relating to any other User as confidential and keep all such information secure, and not share such information with any third party, or use such information for any purpose except in relation to the services that you may provide to them and your use of the website in accordance with our terms of service. You agree to take appropriate security measures (including physical, electronic and procedural measures) to help safeguard such personal data from unauthorized access, loss and disclosure and shall otherwise comply with all applicable laws and regulations relating to data protection.
You shall assist us in providing subject access and allowing data subjects to exercise their rights under applicable laws and assist us in meeting our legal obligations in relation to the security of processing, the notification of personal data breaches and data protection impact assessments. At our request you shall submit to audits and inspections by us to ensure that we are complying with our obligations under this Condition 3.3 and you shall notify us if you are requested to take any action in breach of any applicable data protection legislation.
3.5 If you have agreed to receive marketing communications from us, we will use your personal data to send you such communications. You can choose to no longer receive marketing emails from us by using the un-subscribe link contained in each email we send to you. If you have done this in the first instance to no avail, then you can also contact us by emailing biz@creativityandsense.com. We will typically retain your personal data in our records for marketing purposes until you notify us that you no longer wish to receive marketing emails from us.
3.6 We do not share your personal data with third parties, except (a) to respond to legal requirements including under the Data Protection Act 1998 or from 25 May 2018 under the General Data Protection Regulation (EU2016/679); (b) to protect a third party’s rights, property, or safety; (c) to any service providers, sub-contractors and agents that we may appoint to perform functions on our behalf and in accordance with our instructions and all applicable laws; and (d) in connection with, or during negotiations of, any merger, sale of assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.

4.1 When you use our website, we may automatically collect and store information about your device and your activities. 8.1 You have the right to obtain from us a copy of the personal data that we hold for you, and to require us to correct errors in the personal data that we process for you if it is inaccurate or incomplete. You also have the right at any time to require that we delete your personal data. 8.2 Please note, we reserve the right to charge an administrative fee of £15 if you wish to obtain a copy of the personal data that we hold for you.

However, once you have used these links to leave our website, you should note that we do not have any control over those external websites. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this policy. You should exercise caution where necessary and look at the privacy statement applicable to each site in question.

9.1 If any provision of this policy is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision shall be construed, as nearly as possible, to reflect the intentions of the parties and all other provisions shall remain in full force and effect.
9.2. This policy shall be governed by and construed in accordance with the law of England and Wales, and you agree to submit to the exclusive jurisdiction of the English Courts.
